GORDON V. TOWNSEND. -- JUDGEMENT. -In the Supreme Court, Sydney, on Thursday last, before their honours Sir Alfred Stephen, C.L., Mr Justice Hargrave, and Mr Justice Faucett, the above case, having some degree of local interest in this district, was entertained. It was an appeal from a decree of the Primary Judge in Equity (Mr Justice Hargrave) made in the Ecclesiastical Jurisdiction, in a suit instituted to try the validity of the will of the late Thomas Scott Townsend, formerly of Sydney, but resident some.time before his death in England. His Honour by the decree aforesaid granted probate of the will and awarded costs against the defendant in the suit (Mrs Townsend), who had entered a caveat against the granting of probate. This Court now gave judgment upon the appeal, by the affect of which the Primary Judge's decree was reversed; all costs to be paid out of the estate. The judgment of their Honours will be published in extenso in a future issue.
